GENERAL   conditions

1 APPLICABLE LEGAL REGULATION AND ACCEPTANCE OF TERMS

The General Conditions are subject to in a binding contract between us comes into existence when despatch our confirmation invoice  to the group leader or your travel agent. we both agree that Ethiopian law (and no other) will apply to your contract and any dispute, claim or other matter of any description which arises betweeen us.

 

2 ORGANISATION

The organization of travel makes HASSEN Tour and Travel, with registered offices in Addis Ababa, TAYITU HOTEL, Office No. 374 and Legal Registration Nº. 14/706/3503/2004 provided by the Ministry of Commerce of the Federal Democratic Republic of Ethiopia 

 

3 PRICE

Our packages are cost effective, affordable and moderate. we also offer price discounts, bargains and negotiable customized packages.

3.1 The tour price includes:

For the specific characteristics of each circuit, route or itinerary, you can specify in these conditions the inclusions in the price and the customer will be forwarded to the particular conditions of each route.

 

3.2 The tour price does not include:

Visas, airport taxes, and / or entry and exit rates, vaccination certificates.

 

4 REVIEW OF PRICES

The price of travel is calculated based on exchange rates, transport costs, fuel costs and taxes and fees.

Any change in the price of these elements may lead to the revision of the final price of the trip. These changes will be notified to the consumer, in writing or by any means ensuring consistency of the communication it can made, when the modification is significant, cancel the trip without penalty or accept the contract modification. In any case, be revised upwards during the twenty days preceding the date of trip, on applications already made.

 

5 INFORMATION, REGISTRATION, OFFICE, PAYMENT AND REFUND

Prior information.

Once the client contacts HASSEN  to perform an individual or group tour organized, we request the information necessary for the preparation of a project or inclusion in an organized group, you are informed of the availability of choice requested and provided with detailed information.

When the client requests the development of a customized trip, he may demand payment of an amount for the construction of the project. If the customer accepts the travel budget, the amount paid is deducted from the amount of travel. If HASSEN , for whatever reason, could not confirm the execution of the voyage, the amount paid for this item would be returned in full.

 

Registration.

If the customer is satisfied and decides to enroll, must serve HASSEN  email, and deposit 30% of the total amount of travel. Be issued a receipt which specify, in addition to the amount advanced by the client, the requested trip. No reservation is considered firm until the deposit is formalized.

 

Signature preliminary Contract.

The signing of the preliminary contract with the General Conditions, shall be made at least 20 days before the date of arrival in Ethiopia. In this preliminary contract, customer data, reference, amount, duration, date of travel and anticipated amount will be specified.

 

Contracting and full payment.

On arrival in Ethiopia, on the Offices of Hassen Tour, he shall then sign the contract and payment the remaining amount of the trip. If not proceed to pay the total amount of travel, it is understood that the client waives the requested trip, being applicable the conditions specified in paragraph 6.2

 

Prices for group travel are calculated with a minimum of people traveling together, if not achieved the minimum that each circuit is specified, there will be a price change or cancel your trip. Either option must be communicated to customers with at least ten days in advance. The group out with a number above the minimum does not mean lower prices.

There shall be no refunds for unused services volunteered by the consumer.

The recruitment of the trip comes with the signing of the contract and these general conditions.

 

6 CONSUMER RIGHTS BEFORE YOU TRAVEL

6.1 Transfer of reserves

The travel consumer may transfer his booking to a third party, upon written request of twenty days before the date of commencement of travel. The transferee must meet the same requirements as the transferor, generally required for the package, and both jointly and severally liable to the travel agency to pay the price of travel and additional costs justified the transfer.

 

6.2. Withdrawal

At all times the client may cancel the services requested or contracted, to be entitled to a refund of the amounts that were paid, whether it is the total price of the advance as provided for in the preceding paragraph, but must compensate for the concepts HASSEN  which are listed below:

 

1) The administrative expenses, plus the cancellation fee, if any.

 

2) A penalty, consisting of 5% of the trip if the withdrawal occurs more than ten days and less than fifteen before the date of commencement of travel, 15% between 3 and 10, and 25% within forty-eight hours prior to departure.

 

In the event of force majeure, User shall be borne exclusively cancellation fees, if any, and management costs.

 

No-shows at the scheduled time for departure will not be entitled to a refund of the amount paid, unless the parties agree otherwise.

 

In the event that any of the contracted services and canceled were subject to special recruitment economic conditions, such as freight aircraft, special rates, etc., Cancellation fees for withdrawal is established in accordance with conditions agreed by both parties , never being lower than those established by different service providers.

 

7 CONSUMER RIGHTS FOR CHANGES OF TRAVEL

HASSEN  is committed to providing its clients with all of the contracted services included in the program-offering that gave rise to the contract package, with the stipulated conditions and characteristics, all according to the following:

 

a) In the event that, prior to departure, HASSEN  be forced to significantly modify an essential element of the contract, including price, must immediately inform the customer.

 

b) In such a case the client unless written notice to the contrary, be deemed to have accepted the amendments to the contract which sees the changes made and their impact on the price. The consumer must communicate the decision to HASSEN  listed above within three days from the date of notification of the amendment referred to in paragraph a). In the event that the consumer does not notify its decision on the terms indicated, means opting for the acceptance of amendments to the contract without the receipt of compensation. If you decide to terminate the contract would have the right client up the return of the amount paid.

 

c) If the customer chooses to terminate the contract under the provisions of paragraph b), or that HASSEN  cancel the trip before the agreed date of departure for any reason not attributable to Customer shall be entitled, from the moment it occurs to terminate the contract, the reimbursement of all sums paid. The same right shall be the consumer who does not receive confirmation in the terms specified in the contract.

 

d) In the above assumptions, the Organizer and the Retailer will be responsible for payment of compensation to consumers, if any, appropriate for breach of contract, amounting to 5 percent of the total price of travel booked, whether that failure occurs between two months and fifteen days immediately preceding the expected date of completion of travel, with 10 percent if it occurs between two weeks and three days before and 25 per cent on the assumption that failure is cited occurs within forty-eight hours prior.

 

e) There shall be no liability to compensate by HASSEN  in the following cases:

 

1. When not in the least number of participants in a group trip, provided that written notice at least 5 days before departure.

 

2. When the trip is canceled, due to force majeure, meaning such circumstances beyond abnormal and consequences of which would have been unavoidable, despite having acted with due diligence.

 

f) In no event shall be the responsibility of HASSEN , everything not included in the travel contract (for example, tickets from the place of origin of the passenger to the place of trip, or vice versa, Hotel Reservations on days before or after the trip, etc.).. Since there is no obligation to compensate for these potential costs of independent services in the event that the trip is canceled for the reasons specified in paragraph e).

 

8 CONSUMER RIGHTS DURING THE TRIP

In the event that, after the trip, HASSEN  not provide or verify that you can provide an important part of the services provided under the contract, adopt the right solutions for the onward journey arrangements, at no extra cost to the consumer and, where appropriate, pay the latter the amount of the difference between the services offered and provided. If the client continues the journey with the solutions given by the Organizer, shall be deemed to tacitly accept such proposals.

 

If the solutions adopted by the Organizing unviable or the consumer does not accept reasonable grounds, that it must provide, without extra cost, a means of transport equivalent to that used on the trip back to the place of departure, or any other both have agreed, subject to the compensation if appropriate. In case of complaint, HASSEN  act diligently to find appropriate solutions.

 

The consumer is obliged to report any breach in the contract preferably in situ or otherwise, as soon as possible in writing or otherwise on the record. In the case adjudicated by HASSEN  solutions is unsatisfactory to the consumer, it will have a period of one month to complain. HASSEN provide forty-five calendar days to respond to the complaint by the consumer, which period shall start from the day following the filing of the complaint.

 

9 LIABILITY

9.1 General

HASSEN  respond to the client, the proper performance of the obligations under the contract, regardless of whether they are to be performed by themselves or other service providers, without prejudice to the right of HASSEN  to act against those service providers.

 

HASSEN  liable for damages suffered by consumers as a result of the non-execution or defective execution of the contract. This responsibility shall cease when any of the following circumstances:

 

1. That defects in the performance of the contract are attributable to the consumer.

 

2. Such defects are attributable to a third party unconnected with the provision of benefits under the contract and are unforeseeable or unavoidable.

 

3. Alluded to the defects are due to force majeure, meaning such circumstances beyond the party concerned, unusual and unforeseeable consequences would have been unavoidable, despite having acted with due diligence.

 

4. That defects are due to an event, which despite all due care because he could not foresee or forestall.

 

However, in cases of exclusion of liability for taking any of the circumstances set out in paragraphs 2, 3 and 4 HASSEN  be required to provide necessary assistance to a consumer in difficulty.

 

9.2 Limits on compensation for damage

As to the limit of compensation for damages resulting from failure or improper performance of the services included in the trip, we consider the provisions of international conventions on the subject. HASSEN  accept any responsibility for personal injury, accidents, illness en route, and theft both in the hotels or coaches, loss, damage or total loss of baggage, reminding travelers that there are insurance policies that cover these circumstances.

 

The organization is not responsible for the route of travel, trekking, camping or expedition, the physical discomfort caused by the altitude, weather changes or needs to cross bridges, rivers, or difficult steps.

 

In any case HASSEN  responsible for the cost of accommodation, meals, transport and others arising from causes beyond its control.

 

10 DELIMITATION ON TRAVEL SERVICES CONTRACTED

In air travel, will continue to strictly indicate the specific recommendations provided travel documents to sign the contract.

The means of transportation by road will be adapted to the type of itinerary to be done, and in each case be used, bus, minibus or 4x4 depending on the characteristics of the route and the number of people in the group.

In the description of each circuit will indicate the type of transport to use. The design, structure, comfort and safety of the vehicle can not adapt to the norms and standards of European countries, but which are unique to Ethiopia.

 

11 HOTELS

The quality and content of services provided by the hotel will be determined by the official tourist category, if any, allocated by the competent organ of the country. (See for Ethiopia).

The base price of each circuit are per person based on double rooms, unless otherwise indicated.

 

12 PASSPORTS, VISAS AND DOCUMENTATION

All customers, without exception, must have in order his personal papers and family and especially your passport with an expiration date more than six months. Will be paid by them in obtaining visas, passports, vaccination certificates, etc.. If rejected for a visa Authority, for reasons particular user, or be refused entry into the country due to lack of requirements imposed, or default on the required documentation, or by not carrying the same, HASSEN  held responsible for events of this nature, being borne by the consumer any expense arising, apply in these circumstances the conditions and standards established for the case of voluntary withdrawal of services. It also reminds all users, to be sure, before starting the journey, having fulfilled all the rules and requirements regarding visa in order to enter without problems in Ethiopia. Children under 18 must carry a permit signed by their parents or guardians, in anticipation that the same may be requested by any authority.

HASSEN , as a service to its customers, may take over the management of visas, but does not accept any liability for not having handed over the necessary documentation.

The customer should be aware of the recommendations, warnings and / or warnings that the Ministry of Foreign Affairs of each country carry visitors to Ethiopia and relieve HASSEN  of any responsibility in this regard and for any reason.

 

13 INFORMATIO N TO BE PROVIDED TO CUSTOMER HASSEN

At the time of concluding the contract the client must receive relevant information on specific documentation needed for travel, and advice on the suitability of an insurance policy that covers the cost of cancellation and / or insurance assistance cover repatriation costs in case of accident, illness or death.

14 RIGHT OF ADMISSION, REMOVAL AND DISCIPLINARY

HASSEN  reserves the right to refuse admission and expulsion, if necessary, any person who for his disturbing performance may hinder the smooth running of the travel and living in the group.

 

The traveler expressly exempt the Agency from any liability, claims, contingencies or obligations you may incur in person and / or third parties in connection with possible, suspected and / or proven breaches of legislation or regulation of any kind existing in Ethiopia , expressing such a purpose, meet its obligation in this regard and expressed their firm will abide by and comply with it in all its magnitude.

 

It also undertakes to follow the people responsible for the group or guides HASSEN  exempting, in the same terms as above, in the case of total or partial breach of this obligation.

 

15 GUIDES

The work of the guide begins and ends at the destination, their work is highly technical and contingencies that may arise will not be held responsible. It should be noted a respect for other passengers and the guide and respond to indications of this.

 

16 ON JURISDICTION

Both parties by mutual agreement, waiving the jurisdiction that may be applicable, expressly subject to few differences arising from the interpretation, implementation or enforcement of the travel contract, the jurisdiction of the Courts of Addis Ababa.

 

17  EFFECTIVE

These conditions are effective from October 1, 2014
